1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the Pharmazon website (pharmazon.in) and all associated services provided by Pharmazon B2B Portal Pvt. Ltd. ("Pharmazon", "we", "us", "our").
By visiting, registering on, or using any part of this platform, you ("User", "you") unconditionally accept these Terms. If you do not agree to these Terms, please discontinue use of the platform immediately.
We reserve the right to modify these Terms at any time. Continued use of the platform after any changes constitutes acceptance of the revised Terms.
2. Nature of Services
Pharmazon provides an online B2B directory and marketplace platform that enables:
- Pharmaceutical manufacturers and PCD franchise companies to list their profiles, products, and services.
- Buyers, distributors, and franchise seekers to search for, compare, and contact verified suppliers.
- Business-to-business introductions, lead generation, and enquiry management.
Pharmazon is a technology intermediary as defined under the Information Technology Act, 2000 and is not a manufacturer, seller, distributor, or agent of any pharmaceutical product listed on this platform.
3. Eligibility
Use of Pharmazon is restricted to:
- Individuals who are at least 18 years of age and legally capable of entering into contracts under applicable Indian law.
- Businesses that hold valid drug licences, GST registration, and any other regulatory approvals required for pharmaceutical trading under Indian law.
- Persons accessing the platform for legitimate B2B pharmaceutical business purposes only.
4. Seller / Listing Obligations
Companies listing on Pharmazon must:
- Hold a valid and current Drug Manufacturing Licence (Form 25 / 28) or Drug Sale Licence (Form 20-B / 21-B) as applicable.
- Provide accurate, truthful, and up-to-date information in their company profile and product listings.
- Promptly update their listing if any certification, product, or business information changes.
- Not list counterfeit, adulterated, misbranded, or Schedule H/H1/X drugs in unapproved contexts.
- Respond to genuine buyer enquiries within a reasonable time (recommended: 48 hours).
- Comply with all applicable laws including the Drugs and Cosmetics Act, 1940, CDSCO guidelines, and GST regulations.
5. Buyer Obligations
Users searching for suppliers or submitting enquiries must:
- Use the platform solely for legitimate B2B pharmaceutical business purposes.
- Independently verify the credentials, drug licences, and quality certifications of any supplier before transacting.
- Not submit false, misleading, or spam enquiries.
- Not use supplier contact details obtained from Pharmazon for purposes other than legitimate business enquiries.
- Conduct their own due diligence before entering any business arrangement with a listed supplier.
6. Prohibited Activities
Users must not:
- Post false, misleading, defamatory, or fraudulent content.
- Attempt to scrape, harvest, or mass-extract supplier contact details.
- Use the platform to send spam, unsolicited messages, or bulk marketing communications.
- Impersonate another person, company, or entity.
- Attempt to circumvent, disable, or interfere with platform security features.
- Upload or transmit any malware, viruses, or harmful code.
- Engage in any activity that violates applicable Indian law or regulation.
Violation of these prohibitions may result in immediate account suspension, removal of listings, and legal action.
7. Intellectual Property
All content on Pharmazon — including text, design, graphics, logos, icons, software, and the compilation of all content — is the property of Pharmazon B2B Portal Pvt. Ltd. and is protected by Indian and international copyright laws.
By listing on Pharmazon, you grant us a non-exclusive, royalty-free licence to display, reproduce, and distribute your company name, logo, and product information for the purpose of operating and promoting the platform.
You may not copy, reproduce, republish, or redistribute any content from Pharmazon without prior written permission.
8. Fees & Payments
Basic company listings on Pharmazon are currently offered free of charge. Pharmazon reserves the right to introduce paid premium plans, featured listings, and lead packages in the future. Any such changes will be communicated with reasonable advance notice.
Premium plan fees, once paid, are non-refundable unless Pharmazon is unable to deliver the agreed service due to platform technical failure.
9. Limitation of Liability
Pharmazon shall not be liable for:
- Any loss, damage, or injury resulting from business arrangements made between buyers and sellers through this platform.
- Product quality failures, delivery delays, or financial disputes between users.
- Inaccurate information provided by listed companies.
- Service interruptions, downtime, or data loss due to technical issues or force majeure events.
- Any indirect, consequential, incidental, or punitive damages.
The maximum aggregate liability of Pharmazon for any claim shall be limited to the fees actually paid by the user to Pharmazon in the 3 months preceding the claim.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Chandigarh, India.
The courts of Chandigarh, India shall have exclusive jurisdiction over any matter not subject to arbitration.
